Tasmanian authorities prepare for states power crisis to worsen, says state chief executive

Tasmania's chief executive says he is prepared to use power supply legislation to halt the state's power crisis if he cannot meet the state's demands for more power.

Power demand for Victoria's north and south is a growing factor in Victoria's power price and state electricity minister Andrew Pridmore says states face a looming crisis when a shortage of renewable energy will lead to outages.

Mr Pridmore says states are in a state of "power outages" in Victoria and have to act, arguing the situation is not too dire but it was a "horrible" situation the people of Tasmania faced last year.

"You have states with more wind, and we know more wind. There's more coal in our backyards, we know more coal, I've said that to the people of Tasmania, I've got a message," Mr Pridmore told ABC's 7.30 program.

"If we don't manage it this year, I won't accept the result of the election."

If Victoria fails to meet the state's demands, then the Tasmanian government may be prepared to use power supply legislation to stop it, Mr Pridmore said.

"[We] have a state of emergency already in Tasmania, that's already existed for six months or so," he said.

Mr Pridmore said the issue was similar to another in California.

"A huge problem now in California and we're going to need the authority to do something very similar," he said.

"I'm not sure if it's the power crisis of 2013, but it's the way that we see the electricity crisis going now.

"And one thing that I think is going to be needed is more renewable energy in Tasmania, and I think that is a really, really good idea."

Mr Pridmore said many factors contributed to the state's recent power problems, including drought, the impact of last year's large cyclone and the effects of the state's renewable energy target (RET).

The RET has been implemented to save money, but it also puts pressure on many small generators to go with more efficient generators, which could increase the cost of renewable generation.

Mr Pridmore says the situation is not that bad, but it is causing power outages.

"I'm happy to have the powers to deal with it at any point," he said.

"But at the moment we haven't had a situation in which we've had to say enough is enough and we can do more."

The deaths were linked to a 2010 spill of about two pounds of chlorinated wastewater that caused $7 million in damages and sent 3,000 people to emergency rooms, the state's Environmental Protection Agency said. Another spill from the pipeline occurred in 2015.

The EPA said last year that the company should have used a different pipeline that would have prevented a spill because of the more severe spill at Deepwater Horizon.

There was one other leak, but regulators in West Texas did not consider the spill to be an emergency when they approved Deepwater Horizon's permit.

Deepwater Horizon is part of a sprawling pipeline project to sell oil from the Bakken region of North Dakota, to refineries along the Gulf Coast and to markets along the United States east coast.

The project faces a number of lawsuits, including a federal class action suit from five environmental activists.

The company announced this week that it had paid for $5.6 million in legal fees to resolve the lawsuit.

The state's lawsuit names three major oil companies, but only one, Energy Transfer Partners, has so far acknowledged any wrongdoing. The company has said it expects to bring its case in a federal court in Houston in the next week.

In an interview, the lawyer for the four other plaintiffs said the companies were not aware of wrongdoing from the pipeline until after the 2012 spill and that the safety issues weren't resolved until 2015 and in 2015 only because a company engineer recommended a temporary closure.

"This is just the tip of the iceberg — we are just the tip of the iceberg because it's very difficult to know how severe the disaster is and how long it's going to take and the extent to which it affects other communities in the state," said Richard Carpentier, who was one of the lawyers for a class action lawsuit against Kinder Morgan.

The pipeline is now under the control of a new entity called the North Dakota Department of Environmental Quality.
